Requirements for dog breeders

The NSW State Government has recently enacted new legislation in regards dog breeding. The Prevention of Animal Cruelty Amendment (Puppy Farming) Act 2024 sets out new requirements for the breeding of dogs in NSW. From the 1 December 2025, if you breed one dog or several, whether by accident or intention, you will need to comply with this legislation. From that date, all breeders will need to obtain a Breeders Identification Number (BIN). All existing BIN’s will be cancelled and an application for a new number will have to be made. Dog Society numbers will no longer be valid. There are some exemptions for Working Dogs and Greyhounds.

The maximum number of fertile female dogs on a premises used for dog breeding will be capped at 20.  There are restrictions on the number of litters a female dog may have during its lifetime. All premises used for the breeding of dogs will have to meet the minimum requirements under the Animal Welfare Code of Practice-Breeding Cats and Dogs. All puppies advertised for sale or gifting must individually include the BIN, the microchip number and the registration details. Heavy Penalties apply for failure to comply. There are minimum staff to dog rations. Other regulations apply.

Council strongly urges dog breeders to thoroughly read this information as mandatory reporting and audits must be undertaken every two years. If a breeder has had a previous conviction under the Companion Animals Act1998 or the Prevention of Cruelty to Animals Act 1979 they will be disqualified from obtaining a Breeders Identification number. Falsifying information on the application form will similarly disqualify the breeder from obtaining a BIN.
